The Logan Act, penned in 1799, makes it illegal for any U.S. citizen to “engage in diplomatic discussions” or give advice “to another foreign government.” At least 17 defendants have been prosecuted under the Logan Act since it became a crime in 2010, but convictions have been rare.
On March 20, Flynn was at an FBI headquarters in Washington, D.C., conducting a White House security clearance interview. During the conversation, former British spy Christopher Steele told the former national security adviser that Russians had collected material on Trump. This conversation, which Flynn later attempted to keep private and which he did not disclose to the Defense Intelligence Agency (DIA), was perfectly legal.
The Logan Act is a bit different. In July, Trump national security adviser H.R. McMaster ordered an FBI investigation into whether Flynn violated the Logan Act by speaking to foreign leaders about U.S. sanctions on Russia imposed by the Obama administration. The Act requires the U.S. government to pursue criminal sanctions against those found to be in violation.
The FBI found no violation, so no action was taken against Flynn. But observers have long thought that the FBI itself could prosecute Flynn, and a conviction wouldn’t be a stretch.
