It has now been five years since the class began, and the student’s question still seems to get people’s attention. I’ve heard people ask why it doesn’t matter anymore. It’s not that “they weren’t too into originalism,” but that people have stopped trying to find a convincing way to justify its inclusion in the Constitution.
While this isn’t necessarily a bad thing, it is in fact something very different. The lesson of history shows us that people often have a tendency to forget important things that are important. I’m going to focus my remarks on one specific example: slavery.
Slavery is something that people have forgotten. This is not just a rhetorical point. I’m not saying that people are stupid and don’t remember this, because that’s just not true. I’m saying that slavery is something that people don’t remember at all, and what they do remember is not necessarily what should be remembered.
One thing that people remember about slavery is that the Founders did not include it. Another thing that people remember about slavery is that it had a purpose — punishment. And yet another thing that people remember about slavery is that it was abolished.
